Griddle This uses Talos for online ordering, a platform operated by Excalibur Interactive Solutions, LLC. All orders and transactions are between you and Griddle This. Talos provides the technology platform only. This Terms of Service governs your use of this service.
Welcome to Talos, a platform operated by Excalibur Interactive Solutions, LLC ("Excalibur Interactive," "we," "us," or "our"). By accessing or using the Talos platform at ordertalos.com and any associated subdomains, custom domains, or applications (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms").
These Terms apply to all users of the Service, including restaurant operators ("Restaurant Partners" or "Tenants"), their authorized staff ("Staff Members"), and individuals placing food orders ("Customers" or "Diners"). If you do not agree to these Terms, you must not access or use the Service.
You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to use this Service. If you are under 18, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.
These Terms are supplemented by our Privacy Policy, which describes how we collect, use, and protect your personal information.
The following terms have the meanings set forth below when used in these Terms:
To access certain features of the Service, you must create an account. When registering, you agree to provide accurate, current, and complete information and to update such information to keep it accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account credentials, including your password. You agree to notify Excalibur Interactive immediately of any unauthorized access to or use of your account by contacting us at support@excaliburinteractive.io.
Restaurant Partners are responsible for all Staff Member accounts they create or invite and for ensuring those individuals comply with these Terms. Excalibur Interactive reserves the right to suspend or terminate any account that violates these Terms or is used for unauthorized purposes.
Talos provides a technology platform that enables Restaurant Partners to operate branded online ordering Storefronts and manage their restaurant operations digitally. The Service includes, but is not limited to:
Your data is your data. Talos is built on the principle that Restaurant Partners should have full control over their business information. You will always retain access to your customer data, order history, financial records, and analytics — regardless of your subscription status.
Important: Talos is a technology platform. We are not a restaurant, food service provider, or delivery company. Food quality, accuracy, preparation, safety, and compliance with health regulations are solely the responsibility of the Restaurant Partner.
When a Customer places an order through a Storefront, the resulting transaction is a contract between the Customer and the Restaurant Partner. Excalibur Interactive facilitates the transaction but is not a party to the sale of food or beverages.
Order confirmation does not guarantee availability. Restaurant Partners may cancel or modify orders due to item unavailability, operational constraints, or other reasons. In such cases, the Restaurant Partner is responsible for communicating with the Customer and processing any applicable refunds.
All pricing displayed on Storefronts is set by and the sole responsibility of the Restaurant Partner, including menu item prices, taxes, delivery fees, and service charges. These are presented transparently to the Customer at checkout.
Refund and cancellation policies are at the discretion of each Restaurant Partner. Excalibur Interactive may assist in mediating disputes between Customers and Restaurant Partners but is not obligated to do so and bears no liability for the outcome of such disputes.
Payments made through the Service are processed by third-party payment processors, including Stripe and AMP Payment Systems (Enhanced Gateway). Excalibur Interactive does not directly store, process, or have access to full credit card numbers. Payment data is handled exclusively by PCI DSS-compliant payment processors.
By placing an order, Customers authorize the applicable payment processor to charge the payment method provided at checkout. Saved payment methods are tokenized and stored securely by the payment processor, not by Excalibur Interactive.
Restaurant Partners are responsible for maintaining their own payment processing agreements with the applicable payment processor. Excalibur Interactive is not responsible for payment processor downtime, errors, declined transactions, or disputes handled directly by the payment processor.
This section applies to Restaurant Partners. Restaurant Partners agree to pay subscription fees as specified during onboarding, which may include:
Excalibur Interactive may modify pricing at any time with at least thirty (30) days advance written notice. Non-payment of fees may result in suspension or termination of the Service. Restaurant Partners are responsible for all applicable taxes related to their use of the Service.
The Platform may facilitate delivery through third-party delivery service providers. Excalibur Interactive is not a delivery service and does not employ or control delivery drivers.
Delivery times displayed on the Platform are estimates only and are not guaranteed. Neither Excalibur Interactive nor the Platform is liable for delivery delays, damaged items during transit, incorrect deliveries, or the conduct of third-party delivery drivers. Restaurant Partners may also choose to use their own delivery staff, in which case the Restaurant Partner assumes full responsibility for the delivery experience.
The Talos platform, including its software, code, design, user interface, branding, documentation, and all related intellectual property, is and remains the exclusive property of Excalibur Interactive Solutions, LLC. The Talos name and logo are trademarks of Excalibur Interactive Solutions, LLC.
Restaurant Partners retain full ownership of their Content, including menus, logos, images, and branding materials. By uploading Content to the Platform, Restaurant Partners grant Excalibur Interactive a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute that Content solely for the purpose of operating and providing the Service.
Users may not copy, modify, reverse engineer, decompile, disassemble, or create derivative works of the Platform or any part thereof without the prior written consent of Excalibur Interactive.
Restaurant Partners are solely responsible for all Content they upload to the Platform, including menu items, descriptions, images, and pricing. All Content must comply with applicable laws and must not:
Excalibur Interactive reserves the right to remove any Content that violates these Terms without prior notice. All users of the Service agree not to:
Our collection, use, and protection of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
Restaurant Partners have access to their customers' order data through the dashboard, including names, contact information, delivery addresses, and order history. Restaurant Partners are independently responsible for their own compliance with applicable data protection laws regarding customer data they access through the Platform.
The Platform integrates with and relies upon various third-party services to provide its functionality. These services include, but are not limited to, payment processors, hosting providers, database services, email delivery services, real-time communication services, delivery coordination services, error monitoring services, and infrastructure providers.
Your use of the Platform may be subject to the terms and policies of these third-party providers. Excalibur Interactive is not responsible for the availability, performance, policies, or data practices of any third-party service. Any links to third-party websites or services from a Storefront are the responsibility of the respective Restaurant Partner.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
EXCALIBUR INTERACTIVE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. EXCALIBUR INTERACTIVE MAKES NO REPRESENTATIONS REGARDING THE ACCURACY OR COMPLETENESS OF ANY CONTENT PROVIDED THROUGH THE SERVICE BY RESTAURANT PARTNERS OR OTHER USERS.
Excalibur Interactive is not liable for:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXCALIBUR INTERACTIVE'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO EXCALIBUR INTERACTIVE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to indemnify, defend, and hold harmless Excalibur Interactive Solutions, LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
Restaurant Partners additionally agree to indemnify Excalibur Interactive against claims related to food safety, food quality, menu accuracy, health code compliance, customer disputes arising from orders, and any liability related to the food or beverages they prepare and sell through the Platform.
Either party may terminate use of the Service. Users may close their accounts at any time by contacting support. Excalibur Interactive may suspend or terminate any account or access to the Service for any of the following reasons:
Restaurant Partner Data Access: Upon cancellation or termination of a subscription, Restaurant Partners will continue to have access to their business data, including customer information, order history, and financial records. Talos is committed to ensuring Restaurant Partners maintain full control over the data they have built on the Platform. Restaurant Partners may request a complete export of their data at any time, including during and after the termination process.
While active platform features (such as the Storefront, real-time order management, and payment processing) will be deactivated upon termination, read-only access to historical data will remain available. Restaurant Partners may request permanent deletion of their data at any time by contacting support@excaliburinteractive.io.
The following sections survive termination: Intellectual Property, Disclaimers and Limitations of Liability, Indemnification, and Governing Law and Dispute Resolution.
Excalibur Interactive reserves the right to update or modify these Terms at any time. Material changes will be communicated to users via email notification or a prominent notice on the Platform. The "Last updated" date at the top of this page reflects the most recent revision.
Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of the Service.
These Terms are governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, except where prohibited by applicable law. The arbitration shall take place in the State of New Jersey.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this class action waiver is found to be unenforceable, the entirety of this arbitration provision shall be null and void.
Small Claims Exception: Notwithstanding the above, either party may bring a qualifying claim in small claims court in the State of New Jersey.
Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Excalibur Interactive with respect to your use of the Service and supersede all prior or contemporaneous communications and proposals.
Waiver: The failure of Excalibur Interactive to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment: Excalibur Interactive may assign or transfer these Terms and its rights hereunder without restriction. You may not assign or transfer these Terms without Excalibur Interactive's prior written consent.
Force Majeure: Excalibur Interactive shall not be liable for any failure or delay in performance resulting from circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, internet disruptions, power failures, or third-party service outages.
